House Bill 5512 Must Never Become Law in the State of Michigan! Tell your Senators and Governor to Vote NO on 5512

       House Bill 5512 must never ever become a law in the State of Michigan.  If this bill were to become a law, it would allow a judge to over-ride a decision of a Medical Doctor allowing a person to use Medical Marijuana as a treatment for their condition in Michigan Drug Courts. Defendants would be forced to return to using opioids as an alternative treatment that may lead to complications up to and including death. This bill will affect military veterans in the Veterans Drug Treatment Courts that are trying to kick their Opioid addictions. This bill was fast tracked based on deliberate mis-information from the Michigan Association of Treatment Court Professionals (MATCP) who stated the following:

1. Michigan's treatment courts would lose federal funding by allowing defendants to use Marijuana as their medicine.
2. Public safety was at risk because of defendants being able to drive as a Medical Marijuana patient even though studies have shown that this is not true.
3. The black sheep theory of if someone is using Medical Marijuana then their use of medicine will "corrupt" other defendants in the program
4. MATCP propaganda stating that the law only affects a small number of patients and the change would have a minimal impact upon the Michigan Medical Marijuana Program.

It is not the small number of patients affected that is the problem, it is the gall of the MATCP.  Changing a citizen initiated law in this manner goes against the integrity of the law and, is a slap in the face to the voters in Michigan. 2 million people voted for one thing and 84 House of Representatives told them to go to hell.

One patient affected is one too many, especially when this legislation was devised by deliberate mis-information from this organization. Furthermore the Substance Abuse and Mental Health Administration  (SAMSHA) issued a clarification memo on January 1st, 2020 to clarify the agency's position regarding Medical Marijuana use and federal funding. In a nutshell, they stated that a person can use Marijuana as a medicine as long as they defendant is advised that there are other drugs that they can take.

Furthermore SAMSHA stated that medical marijuana patients can in fact attend drug court even when it is federally funded.

This bill passed out of the Michigan House of Representatives by an 84 to 17 margin. This was more that the 3/4 majority of 110 representatives needed to advance this bill to the Michigan Senate. With the help of Democrats, including members of the Michigan Legislative Cannabis Caucus, did not take the time to read the SAMSHA memo of January 2020 voted YES against their constituents. They should be remembered at the ballot box in the August 2022 Primary and, November General Election of 2022 with a NO vote.

Now is the time to contact every Senator in Michigan at www.senate.michigan.gov and let them know to vote NO on House Bill 5512. Some of these legislators are running for higher office at State and Federal levels. Some are looking to be returned to Lansing in 2023 as Senators and Representatives. You must contact them through email, voicemail messages and, personal appointments to let your feelings be heard or, they will not get your vote this time.

Starting with Senator Mike Shirkey @ www.senatormikeshirkey.com, please take the time to state your objection to HB 5512 and, don't forget to contact the Office of the Governor and let them know to veto this bill. Additionally please contact the members of the Senate Regulatory Reform Committee. One of the members of the committee was former Secretary of State Ruth Johnson who refused to place the driver's license picture on the Medical Marijuana card for selfish reasons and, now is threatening to harm the MMMA again with this piece of damaged legislation.

Therefore, send your objections to the House Bill 5512 in an email or, call and leave a message on their voicemail NOW, because time is of the essence. The same Representatives and Senators are planning to support the anti-caregiver bills 5300, 5301, and 5301 that will take patients plants and, give them to corporate interests who's only concern is profit, profit, profit. If this action succeeds, the legislature will be successful screwing the caregivers who fought and died to make medicine available to patients in need.

      Right before the 2020 pandemic on January 29th, 2020, Daniel Dario Trevino of Lansing Michigan was sentenced to 15 years of prison for being a Marijuana businessman and educator. Seems that Mr. Trevino was successful 26 times in state court defending himself as a legitimate marijuana businessman and entrepreneur.  Mr. Trevino gave countless number of classes on how to grow and maintain a marijuana business. Unfortunately, his nemesis Attorney General Bill Schuette was so enraged at his victories in state court that he went judge shopping at the federal level.  The federal court divides the state in half with an Eastern District in Detroit and the Western District in Grand Rapids.  The justice served is like night and day because some of the most harshest and dysfunctional decisions of law come out of the Western District.

Now comes the case of the plot to kidnap and kill Governor Gretchen Whitmer for requiring people to use masks during the raging days of the pandemic. After all was said and done by the defendants, two of them were acquitted by the same jury pool who convicted Danny Trevino.  This makes sense when you factor in politics and race.  Trevino was forced to change his ethnic group from Hispanic to White to avoid getting more time added to his sentence. Grand Rapids is a hotbed for dysfunctional justice and judicial malfeasance.

To bring this to the attention of Federal officials, you must contact the White House at www.whitehouse.gov/contact  and call (202) 456-1111 on Tuesdays through Thursdays from 11:00am to 3pm Eastern Standard Time to leave a message with President Joe Biden and Vice President Kamala Harris to issue an executive order to expunge all federal pot prisoners from the Federal Bureau of Prisons supervision, including all housing units.

 

The racist policies of the Western District Court must be called out and action taken up to and including impeaching Federal Judges from the bench. Marijuana laws have been changing in nationally to include 38 out of 50 states allowing medical and recreational marijuana within their borders.  The time is now to end the hypocrisy in our bureaucracy!

The Weed Has Been Freed with a Picture ID from the Michigan Marijuana Regulatory Agency.

After 12 years of bureaucratic neglect and indifference, The Michigan Medical Marijuana card has become an official government issued valid ID with a picture on it. Personal Identifiable Information from your driver’s license like your drivers license number will no longer be available to 3^rd party websites at provisioning centers. This will protect patients from identity theft by scrupulous business owners and identity theft.

We must give proper kudos to State Representative Cynthia A. Johnson(D5), Marijuana Regulatory Agency Director Andrew Brisbo and, the staff who brought the agency into compliance with the Law. We also want to give thanks to Michigan Secretary of State Jocelyn Benson for supporting the law of the land.

To get your new ID card and picture you must go to the MRA website at www.michigan.gov/mra and select MMMP Patients and Caregivers from the menu.

1. Scroll down the page and look for the red button saying registration cards with picture on it. 
2. Select that button and information is there to get a new card online or, download and fill out the paper form and mail it in.  

If you are a current participant of the MMJ program, a new card will be sent to you free of charge.  Otherwise, when it is time to renew your card, your new card will have your picture it.

With the new card you will be able to get medicine from provisioning centers, vote in elections, cash checks, and present this to anyone asking for a valid government ID.  As of this writing Michigan will recognize patient cards from 38 states and counting. To amend the US constitution, you need a minimum of 38 states out of 50 to ratify a change allowing the agriculture industry to use of Cannabis as a medicine, biofuels to fight climate change, and manufacturing for raw goods. Finally, amending the constitution will help facilitate the immediate expungement of all federal pot prisoners in the bureau of Federal Bureau of Prisons, besides an executive order from President Joe Biden.

While recreational marijuana is legal in many states, a medical card will give you added legal protection from HIPPA and internationally. On a federal and international level, there are existing treaties between the United States and other countries that have been in place for over 80+ years.  These treaties need to be set aside to finally end the stigma against cannabis. To do that we must vote in every election to make sure that the people representing you in Washington DC are supporting cannabis reform.  If they get elected and stray, you must make them pay at the ballot box.   If you have an elected official that IS supporting cannabis, then you must elect and re-elect them to office.

With adherence to perseverance, any goal can be achieved, any task can be accomplished.

NOW is The Time To Stop Legislative Voter Fraud in Lansing Michigan Regarding Marijuana Laws

Corporate marijuana interests are working very hard to rewrite our voter enacted Marijuana laws in Lansing Michigan. If House bills 5300-5302 become law, it will be another reminder of how the emergency manager law was reinstated after people soundly rejected it at the ballot box. The Michigan legislature upon it’s own motion will remove 11 plants and 4 patients from caregivers after the voters chose to have 12 plants and 5 patients to provide caregiver services to. Additionally, the rewrite will create a new felony charges, increase fines and, incarceration of our citizens violators of the new law if approved. The bills are being fast tracked by interests who want to monopolize the Marijuana Industry in Michigan by March 22, 2022.

On Tuesday October 26, 2021 the regulatory reform committee approved these bills for a full vote by the entire 110 member Michigan House of Representatives.  The plan is to have these laws passed by the House of Representatives by November 5^th, 2021 with minimal input from citizen caregivers.

This attempt by Michigan Legislators goes against everything the late Representative Isaac Robinson fought against because of the increased civil penalties, fines and, imprisonment for possession of marijuana. Any representative voting YES for these bills will help increase operational costs in the District Courts, Department of Corrections and, county jails.

This is a glaring example of legislative voter fraud because the current law was approved by 63% of the citizens with their vote in 2008.  The voters decided that they wanted 12 plants and 5 patient caregivers and, if a law needs to be changed, it should be done by the voters not the politicians. This effort to disenfranchise the voters by changing the law in the middle of the night, combined with the enactment of voter suppression laws leads to citizen mistrust of government 

There are a lot of real pressing problems in the State that need to be fast tracked into law like illegal dumping, infrastructure repair, education reform, and removing the taxes from retiree pensions for example. The same people who want a picture ID to vote will not force the Department of Licensing and Regulation, Marijuana Regulatory Agency to reprint all patient and caregiver cards with their picture on it. It is the law that your driver’s license picture should be on all Michigan issued patient/caregiver Marijuana cards.

If you want to stop this behind the back door plan to change voter enacted laws by special interest groups, I strongly encourage you to call, email, write and, visit in person any State Representative and Senator to vote NO, NO and, NO on House bills 5300, 5301 and, 5302 when they come up for a vote.

Contact Michigan State Representatives and Senators to Stop The Looters of Michigan's Marijuana Industry

If you love your cannabis plants, you are strongly encouraged to contact any Michigan Legislative branch member to stop the implementation of any piece of legislation that will regulate how many plants a patient can have.  The people voted for 12 plants and, it shall remain 12 plants, because the citizens said so with their ballot.  The attempted coup on the Marijuana industry if successful, will lead to increase incarcerations and property seizures by  State and local governments.  People with felonies will be barred from participating in the industry by new rules if approved by the Governor.  

The people who crafted the legislation were not inclusive of people of color and, aligned with the pipeline to prison industry. With the additional restrictions small business will be completely eliminated. Farmers will become instant criminals for having too many plants because the new rules will only allow you to have one plant and one patient to care for. Excess plants must be destroyed and violators will be severely punished. Urban farmers will be filling the jails in Detroit, Lansing, Flint, Benton Harbor, Grand Rapids. Rural farmers will be sitting in county jails next to people hooked on Opioids and Meth for a plant.

Therefore you must contact her office now and tell her to VETO this attempted theft of caregiver rights in advance! 

It only takes a few minutes and, if enough of you contact the Governor's office, State Representatives and, Senators we make our legislators develop a better system that will not penalize caregivers and promotes education. Especially science teachers in K-12 institutions and, students in college studying subjects in agriculture and business management for example.

Your message to your Representative or Senator is that if you vote to approve this legislation in 2021, we will remember you in 2022.  The Marijuana Community is a community of interest that is not reflected in the Census however, it is reflected at the ballot box. So let them know to vote no on House Bills 5300, 5301, 5302, or, any legislation that negatively affects the Cannabis Community of Interest.  

Voter disenfranchisement in Michigan will not be tolerated!

On September 14, 2021, Representative T.C. Clements introduced House Bill 5300, 5301 and 5302 which would amend multiple acts that regulate medical marijuana. This bill was referred to the committee on Regulatory Reform.

In Michigan, laws must originate as bills in the Legislature and proceed through the legislative progress. Article IV, Section 22 of the Constitution of the state of Michigan of 1963, as amended, states “all legislation shall be by bill and may originate in either house.” As Governor, I am unable to introduce a bill myself in the Legislature.

If a bill is passed by both chambers in identical form, the bill will then be sent to my desk. From there I have 14 days to make a decision to either sign the bill into law or to veto the bill. As a result, I would encourage you to share your opinions and concerns with your state legislators if you have not already done so.

House Bill 5302 - Voter Photo ID Concerns and Election Integrity Issues - Opposed

Dear Regulatory Reform Committee,

After further review, if this bill were to become law, it would ignore the fact that a picture from the Secretary of State office is missing for customers of the Marijuana Regulatory Agency's Medical Marijuana program.  This proposed  bill discusses bidding for a third party vendor to manage the METRIC system for tracking retail sales. Meanwhile, the only people who had pictures on their cards were law enforcement employees that were looking for an arrest and conviction on drug charges. 

Especially in Oakland County where a man lost his life for growing marijuana by Oakland County Sherriff deputies with forged IDs. Not to mention Ingham County Sherriff deputies with pictures on their cards, trying to purchase cannabis products from a business owner in Lansing MI in 2009. 

This committee must issue a memo directing MRA to enforce the law and, re-issue every participant a new card with a picture on it. Currently the State of Michigan is breaking the law (link to PA 306 - Section 2 - Part 6(e)), specifically by not having a picture on the Medical Marijuana card. 

This deliberate oversight must be corrected.

Regulatory Reform

This would assist in election security issues giving citizens the choice of another valid photo ID as required by State law. This would help business transactions that require two pieces of valid identification increasing chances for economic growth. House bills, 5300, 5301 and 5302, must be withdrawn. If these bills are not withdrawn, we want every Rep to vote NO on all of these bills with a veto by Governor Gretchen Whitmer in advance.
